By-Laws For The Operation Of St. Anne’s Anglican Cemetery

Definitions used in “The Cemeteries Act” (revised April 1, 1992) herein after referred to as the “Act”, which are pertinent to these By-Laws:
- “by-laws”, when used in relation to a cemetery, means the rules under which the cemetery is operated.
- “lot” means an area of land in a cemetery containing, or set aside to contain human remains.
- “marker” means any monument, tombstone, plaque, headstone, cornerstone or other structure or ornament affixed to, or intended to be fixed to, a burial lot intended for the interment of human remains.
- "columbarium" is a structure divided into niches specifically designed to hold cremated remains.

  1. The Parish Council for St. Anne’s Church is the governing body for St.Anne’s Cemetery. The only officer associated directly with the cemetery is the Secretary/Treasurer. This position is filled each year through appointment at the annual Vestry Meeting.
  2. At the rates set out in the “Tariff of Rates”, when a parishioner purchases the Interment Rights to a lot, the appropriate contribution to the Care and Maintenance Fund will be included in the purchase price. When a marker is purchased, the appropriate Care and Maintenance contribution is to be paid directly to St. Anne’s Cemetery, either by the parishioner or by the monument company
  3. St. Anne’s Cemetery shall maintain, without any charge to interment rights holders other than the interest from the care and maintenance funds, the grounds of the cemetery including all lots, structures and markers.
  4. Regular lots, 8’x3’, and cremation lots, 3’x2’4”, and columbarium niches as laid out on the plan will be sold by the Secretary/Treasurer at rates set out in the Tariff of Rates. The fee for Scattering is not subject to any Care and Maintenance fee.
  5. The Secretary/Treasurer will provide each Interment Rights owner, at the time of sale, the following:
     a) a copy of the Contract
     b) a copy of the Cemetery By-Laws
     c) a copy of the Tariff of Rates
     d) upon payment in full, a Certificate of Interment Rights listing the name(s) of the person(s) to be interred in that lot.
  6. No interment will be made without the written request/permission of the Interment Rights holder or his/her authorized representative. This request must be presented to the Secretary/Treasurer of St. Anne’s Cemetery. The Contract Form shall be used to make this request. A burial permit is required before an interment can be conducted.
  7. Since the purpose of continuing St. Anne’s Cemetery on an active basis is for the benefit of the parishioners of St. Anne’s Church, the sale of lots is restricted to members of the Vestry of St. Anne’s, for use by members of St. Anne’s Church. The proposed user shall be named at time of purchase. 
    Non-members of St. Anne’s Church may be interred only on the approval of the St. Anne’s Cemetery Board.
  8. The owner of a lot may transfer the Interment Rights to another individual, but the Certificate of Interment Rights can not be transferred. The Certificate must be returned to the Secretary/Treasurer, who will issue a new certificate to the transferee. The fee for this transfer is set out in the Tariff of Rates.
  9. St. Anne’s Cemetery, through the Secretary/Treasurer, upon the written request of the purchaser or his/her heirs, may re-purchase the Interment Rights for a lot any time before it is used. St. Anne’s Cemetery will re-purchase the lot for the original purchase price, including any amount paid to the Care and Maintenance Fund.
  10. Cremated human remains may be buried in a relative's lot with the written request/permission of the Interment Rights holder or his/her heirs.
  11. Scattering of cremated remains will be allowed only in the scattering area and the fee for this service is outlined in the Tariffs and Rates.
  12. A maximum of one marker at the head of the grave and one flat marker flush with the ground at the foot of the  grave will be permitted for a regular 8’x3’ lot. Only one marker will be permitted for a 3’x2’4” cremation lot, as defined in paragraph 13.
  13. Any marker that is longer than two feet (2’) and that is not flush with the ground shall be placed on a foundation that is not less than five feet (5’) deep. Markers for the cremation lots (3’x2’4”) shall be flat and placed flush to the ground with a 2” concrete border around a 24”x12” granite marker. These markers shall be installed centrally on the lot and on the west side so that the writing is read from the east.
  14. The Rector of St. Anne’s Church, or in his absence one of the church wardens, shall be notified of each interment at least 12 hours before the service, unless special circumstances prevent this.
  15. No interment shall be made on Sunday except on a doctor’s certificate that burial must be made within 24 hours of death in accordance with the regulations of the Ontario Ministry of Health for control of communicable diseases and the current Cemeteries Act.
  16. No Body shall be moved of disinterred without the written consent of the local Officer of Health and the owner of the lot, except on an order from the court as provided in the Regulations under the cemeteries Act.
  17. If any trees or shrubs situated in any lot have become, by means of their roots or their branches or in any other way, detrimental to the adjacent lots or prejudicial to the general appearance of the cemetery grounds, the Cemetery Board may remove such trees or shrubs or parts thereof, after the owner of the lot has been given 90 days notice to correct the situation and has failed to comply.
  18. No person shall do work upon a burial lot without the permission of the Secretary/Treasurer of St. Anne’s Cemetery.
  19. The erection of borders, fences, railings, walls and hedges in and around lots is prohibited. Flower gardens may be installed only on a regular lot.
    Built-in bronze vases encased in concrete may be installed on either type of lot by the owner or his/her heirs who will be responsible for their maintenance.
  20. Children under the age of 12 years are not admitted to the grounds except when accompanied by an adult, who shall be responsible for their good conduct.
  21. Dogs and other pets may be brought onto the cemetery grounds provided they are securely confined or leashed and are not allowed to run at large.
    Any person bringing a pet onto the cemetery grounds shall be responsible for the removal of any excrement.
  22. Interment Rights holders are requested to provide a timely written notice to the Secretary/Treasurer of a change of mailing address.
  23. These by-Laws shall come into force on the date they are approved by the Minister of Consumer and Business Relations and they shall remain in force until such time as they are amended and approved by the Minister.
